Gifts — Undue Influence.

Where a man eighty-two years of age, who had shown for some years signs of mental deterioration, and whose memory was impaired and mind confused at the time of taking his testimony, bought from a new acquaintance, a business woman, the house in which she lived, for considerably more than its apparent market value, he then going there to board with her, and subsequently gave her a half interest in the house and also an automobile, held that, in view of the circumstances, and the contradictory and apparently incredible testimony by the recipient of the gifts, in justification thereof, the gifts should be set aside as procured by undue influence.

Appeal from the Circuit Court No. 2 of Baltimore City (LESER, J.).

Bill by John C. Erb against Rena R. Rondous. From a decree for plaintiff, defendant appeals. Affirmed.
