On April 21, 2022, counsel for respondent filed with the Court a Motion to Dismiss for Lack of Prosecution. On May 16, 2022, petitioner filed a motion for continuance expressing health concerns.

This case was called from the calendar for the Trial Session of the Court at New York, NY on May 16, 2022. Petitioner did not appear due to health concerns. Counsel for respondent appeared and orally moved the Court for a continuance in this case. Upon due consideration and for cause more fully appearing in the transcript of the proceedings, it is

ORDERED that respondent's motion to dismiss for lack of prosecution, filed April 21, 2022, is denied without prejudice. It is further

ORDERED that petitioner's motion for continuance is granted. It is further

ORDERED that respondent's oral motion for a continuance is granted, and this case is continued generally.
