ROMA INDEPENDENT SCHOOL DISTRICT, Appellant v. Noelia M. GUILLEN, Raul Moreno, Dagoberto Salinas, and Tony Saenz, Appellees

From the 229th Judicial District Court, Starr County, Texas

Trial Court No. DC-13-64

David Wellington Chew, Judge Presiding

ORDER

Appellant's brief in this accelerated appeal was due May 28, 2013. On May 24, appellant filed a motion for a twenty-one day extension of time to file the brief, asserting the motion is "unopposed," but that counsel for appellees could not be reached for conference. Appellees have filed a response, opposing the requested extension and disputing appellant's assertion about counsel's unavailability to confer.

We grant the motion and order appellant's brief due June 18, 2013. No further extensions of time will be granted absent a showing of extraordinary circumstances and a good faith effort to confer with opposing counsel. If the brief is not filed by the date ordered, the appeal may be dismissed for want of prosecution. See Tex. R. App. P. 38.8(a).

Appellant's motion states the underlying cause was set for trial June 3, 2013. We order the parties to notify this court if there is a final ruling on the merits.
