Darnell ROGERS, Appellant v. The STATE of Texas, Appellee

From the 227th Judicial District Court, Bexar County, Texas
Trial Court No. 2015CR12728
Honorable Kevin M. O'Connell, Judge Presiding

ORDER

After we granted Appellant's first and second motions for extension of time to file the brief, Appellant's brief was due on September 8, 2017. See TEX. R. APP. P. 38.6(a). Appellant filed a motion for extension of time on September 5, 2017, a "Notice of Erratum" on September 6, 2017, and a final motion for extension of time on September 8, 2017. The motions for extension of time were based in part on an incomplete reporter's record. Appellant has asked the court reporter to prepare and file a supplement reporter's record, and the court reporter has indicated she will file it on or around September 19, 2017. Appellant stated he would not request any further extensions.

Appellant's September 8, 2017 motion for extension of time to file the brief until October 9, 2017 is GRANTED. We ORDER Appellant to file the brief not later than October 9, 2017. Appellant's September 5, 2017 motion is MOOT.
