KARL A. ROEHM, Petitioner v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Cary Douglas Pugh Judge

This case is currently set for trial at the Court's March 4, 2024, Denver, Colorado trial session. On January 8, 2024, respondent filed a Motion to Remand, requesting that this case be "remanded to the Office of Appeals in order that the hearing prescribed by section 6330 may be conducted with petitioner and/or a duly authorized representative." On January 9, 2024, we directed petitioner to file a response by February 8, 2024. To date, we have not received a response from petitioner. Upon due consideration and for cause, it is hereby

ORDERED that this case is stricken from the Court's March 4, 2024, Denver, Colorado trial session and continued, and jurisdiction is retained by this Division of the Court. It is further

ORDERED that respondent's Motion to Remand, filed January 8, 2024, is granted, and this case is remanded to respondent's Appeals Office for further proceedings consistent with the matters discussed in the motion. It is further

ORDERED that the above-referenced hearing shall take place at respondent's Office of Appeals located closest to petitioner's residence or at another mutually acceptable location, and at a reasonable and mutually agreed upon date and time, but no later than April 21, 2024. It is further

ORDERED that, on or before May 21, 2024, the parties shall file status reports regarding the then-present status of this case.
