VICTOR RODRIGUEZ, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the 204th Judicial District Court Dallas County, Texas
Trial Court Cause No. F13-40777-Q

ORDER

The Court REINSTATES the appeal.

By order entered January 7, 2016, we denied appellant's second motion to extend time to file his brief and ordered the trial court to make findings. On January 29, 2016, the trial court filed findings with the Court.

We ADOPT the findings that: (1) appellant desires to pursue the appeal; (2) appellant is indigent and represented on appeal by appointed counsel Dianne McVay; (3) counsel's explanation for the delay in filing appellant's brief is an incomplete clerk's record that was not supplemented until January 25, 2016; and (4) counsel informed the trial court appellant's brief would be filed within thirty days.

We GRANT appellant's January 26, 2016 third motion for extension of time to file appellant's brief. We ORDER appellant to file his brief within THIRTY DAYS of the date of this order.

We DIRECT the Clerk to send copies of this order, by electronic transmission, to counsel for all parties.
