[PROPOSED] JUDGMENT
Pursuant to the jury's verdict of July 29, 2011,
IT IS HEREBY ORDERED, ADJUDGED AND DECREED that defendant Deputy Gregory Swoboda shall have judgment entered in his favor on plaintiff's claim of Unreasonable Search and Seizure - Excessive Force (42 U.S.C. §1983);
Pursuant to this Court's Minute Order of May 10, 2011,
IT IS HEREBY ORDERED, ADJUDGED AND DECREED that defendant Deputy Joe Necochea shall have judgment entered in his favor on plaintiff's claim of Unreasonable Search and Seizure - Excessive Force (42 U.S.C. §1983);
IT IS HEREBY ORDERED, ADJUDGED AND DECREED that defendants Deputy Gregory Swoboda, Deputy Joe Necochea, Sergeant Linzy Savage and DOE Officesshall have judgment entered in their favor on plaintiff's claim of Unreasonable Search and Seizure Detention, Arrest and Malicious Prosecution (42 U.S.C. §1983);
IT IS HEREBY ORDERED, ADJUDGED AND DECREED that defendant County of San Bernardino and DOE Supervisors shall have judgment entered in their favor on plaintiff's Municipal Liability for Unconstitutional Custom, Practice or Policy Claim; and
IT IS FURTHER ORDERED, ADJUDGED AND DECREED that plaintiff Juventino Rodriguez takes nothing and defendants, Deputy Gregory Swoboda, Deputy Joe Necochea, Sergeant Linzy Savage and the County of San Bernardino shall recover costs of suit.
