The reporter's record was due on August 14, 2023. On August 17, 2023, the court reporter advised this Court that a reporter's record existed but that appellant had not requested or made financial arrangements for the filing of the reporter's record. A notice issued to appellant that the reporter's record had not been requested or filed and that the Court might require appellant to file a brief without the benefit of a reporter's record unless appellant filed a response showing payment by September 18, 2023. No response was filed. On October 2, 2023, appellant filed a brief. Accordingly, unless appellant files a response within 10 days, the Court will presume that appellant has asserted issues in its brief that do not require a reporter's record for a decision. See Tex. R. App. P. 37.3(c).

It is so ORDERED.
