District Court of Appeal of Florida, Second District
Feb 24, 1984
445 So. 2d 698 (Fla. Dist. Ct. App. 1984)

Opinion

No. 83-373.

February 24, 1984.

Appeal from the Circuit Court, Hillsborough County, Daniel E. Gallagher, J.

Gary W. Nicholson of Carson Guemmer, Tampa, for appellant/cross-appellee.

R. Wayne Miller and Debra L. Romanello of Moffitt, Hart Miller, Tampa, for appellee/cross-appellant.

AFFIRMED. We do not find an abuse of discretion in the trial court's order granting a new trial, see Castlewood International Corp. v. LaFleur, 322 So.2d 520 (Fla. 1975), or in the trial court's exclusion of evidence concerning prior accidents at other locations on the same premises, see Lawrence v. Florida East Coast Railway Co., 346 So.2d 1012 (Fla. 1977).

HOBSON, A.C.J., and SCHEB and LEHAN, JJ., concur.
