Rockville Iron Works v. Silverite Construction

Appellate Division of the Supreme Court of New York, Second Department
Apr 11, 1977
57 A.D.2d 566 (N.Y. App. Div. 1977)

Opinion

April 11, 1977

In an action, inter alia, to recover for certain labor and materials furnished, defendants appeal from so much of an order of the Supreme Court, Nassau County, dated November 30, 1976, as denied their motion for partial summary judgment. Order affirmed insofar as appealed from, with $50 costs and disbursements. As there are triable issues of fact, the motion was properly denied. Cohalan, Acting P.J., Hawkins, Suozzi and Mollen, JJ., concur.
