Hilary Rochelle v. Travis Services Group, Inc. and Travis Company d/b/a Puroclean Services

Trial court: 269th District Court of Harris County Trial court case number: 2017-53392

ORDER

Amparo Guerra Judge

On January 3, 2023, appellant/cross-appellee, Hilary Rochelle, filed a notice of appeal from the trial court's October 7, 2022 final judgment. On January 4, 2023, appellees/cross-appellants, Travis Services Group, Inc. and Travis Company, doing business as Puroclean Services (collectively, "Travis Services"), filed a notice of appeal from the October 7, 2022 final judgment.

The clerk's record was filed with the Clerk of this Court on February 8, 2023, and the reporter's record was filed on April 10, 2023. Accordingly, pursuant to the Texas Rules of Appellate Procedure, the deadline for any appellant to file an appellant's brief is May 10, 2023. See Tex. R. App. P. 38.6(a). Pursuant to the rules, appellant and cross-appellants would generally be required to file an appellant's brief not exceeding 15,000 words by that date. See Tex. R. App. P. 9.4(i)(2)(B). After appellant and cross-appellants filed their respective briefs, appellees and cross-appellee would be required to file their appellees' briefs, not exceeding 15,000 words, within thirty days of the filing of appellant/cross-appellants' briefs. See Tex. R. App. P. 9.4(i)(2)(B), 38.6(b). Finally, appellant and cross-appellants would be entitled to file a reply brief, not to exceed 7,500 words, within twenty days of the filing of appellee's and cross-appellees' briefs. See Tex. R. App. P. 9.4(i)(2)(C), 38.6(c).

On April 6, 2023 the parties filed a "Joint Motion to Modify Briefing Schedule." In their motion, the parties "request that the briefing schedule in the appeal and cross-appeal be condensed to four briefs, rather than six." The parties proposed a modified schedule, including deadlines and word limits.

The parties' motion was filed before the completion of the appellate record, and therefore did not contain specific dates for the filing of briefing. The appellate record has now been completed, and the deadlines included in this order are based on the date the appellate record was completed.

The parties' motion is granted. The schedule provided below governs the briefing for this appeal and cross-appeal.
