On April 25, 2023, we ordered court reporter Cathye Moreno to file the reporter's record in this appeal and noted that it appeared that the hearing that led to the appealed judgment was held December 15, 2022. Ms. Moreno failed to file the record by May 25, 2023, as ordered to do so, and on June 14, 2023, we ordered her to file the record, or written verification no record exists, no later than June 29, 2023. To date, neither has been filed.
This appeal cannot proceed until the issue of the reporter's record is resolved. Accordingly, we ORDER Ms. Moreno to file the record or requested verification NO LATER THAN August 6, 2023. As we have noted in our previous orders, because appellant filed a statement of inability to afford payment of costs, any record shall be filed without costs. See Tex. R. Civ. P. 145.
We expressly CAUTION Ms. Moreno that failure to comply with this order may result in an order that she not sit as a court reporter until she complies.
We DIRECT the Clerk of the Court to send copies of this order to the Honorable D'Metria Benson, Presiding Judge of County Court at Law No. 1; Ms. Moreno; and the parties.
