ALVIE ROBINSON, Appellant v. ALICIA SCOTT AND BRANDEN MULLENS, Appellees

From the 278th District Court Walker County, Texas
Trial Court No. 25,737

ORDER

Alvie Robinson, a prison inmate, is appealing the trial court's dismissal of Robinson's claims of conversion and theft pursuant to a plea to the jurisdiction filed by Alicia Scott and Brandon Mullens.

By letter dated July 13, 2016, the clerk of this Court notified Robinson that he had not provided a certified copy of his "inmate trust account" statement as required by section 14.006(f) of the Texas Civil Practice and Remedies Code. See TEX. CIV. PRAC. & REM. CODE ANN. § 14.006(f) (West 2002). Robinson was warned that the Court would dismiss this appeal unless, within 14 days from the date of the letter, a certified copy of Robinson's "inmate trust account" statement was filed with this Court. On July 25, 2016, the Court received a letter from Robinson with what purports to be a certified copy of Robinson's "inmate trust account" statement enclosed. However, Robinson's certified copy of his "inmate trust account" statement is neither legible nor served on the opposing parties' counsel. See TEX. R. APP. P. 9.5.

Accordingly, the "inmate trust account" statement is stricken. Robinson has 14 days from the date of this Order to file a certified copy of his "inmate trust account" statement which the Court can read and provide proper proof of service on opposing counsel. The failure to timely provide a legible, certified copy of the "inmate trust account" statement which is properly served will result in the dismissal of this appeal without further notification for failure to comply with an order of the Court. TEX. R. APP. P. 42.3(c).

PER CURIAM Before Chief Justice Gray, Justice Davis, and Justice Scoggins
Certified copy stricken
Order issued and filed August 3, 2016
