Opinion

No. 08-1453.

May 29, 2009.

Appeal from the Iowa District Court for Lee (South) County, Cynthia Danielson, Judge.

A father appeals from a district court ruling establishing child custody and visitation. AFFIRMED.

Thomas D. Marion of Marion Law Office, Keokuk, for appellant.

Steven J. Swan of Swan Associates Law Office, Keokuk, for appellee.

Considered by Mahan, P.J., and Eisenhauer and Mansfield, JJ.

Brooklyn, born in October 2007, is the daughter of Larry Roberts and Amy Rohrbough. Larry initiated this proceeding to establish custody, child and medical support, personal exemption, and visitation rights between the parents. Following a two-day trial, the district court determined both parents love Brooklyn, have actively cared for her, and want what is best for her. The court expressed concern regarding the parents' inability to effectively communicate with each other and with Larry's failure to comply with his court-ordered child support obligations for Brooklyn throughout these proceedings. The court granted joint legal custody and awarded physical care to Amy. Larry was awarded liberal visitation. Larry appeals.

Larry contends the court should have awarded physical care to him, or in the alternative, should have awarded joint physical care to both parties. After a thorough review and consideration of the record, we agree with the district court's decision. The court's ruling is lengthy and well-written, and it is obvious the court considered all the issues in this case in coming to its conclusion. Therefore, we affirm.

AFFIRMED.
