This case was set for trial at the Court's April 11, 2022, Detroit, Michigan trial session, and then re-calendared for the Court's May 16, 2022, Burlington, Vermont remote trial session.

On March 11, 2022, respondent filed a Motion to Dismiss for Lack of Prosecution. By order served March 18, 2022, the Court ordered petitioner to file an objection to respondent's motion and set respondent's motion for hearing. On April 8, 2022, the parties submitted a Proposed Stipulated Decision resolving all issues for taxable year 2019. The Court entered the Stipulated Decision on April 12, 2022.

Upon due consideration and for cause, it is

ORDERED that respondent's Motion to Dismiss for Lack of Prosecution, filed March 11, 2022, is hereby denied as moot.
