MEMORANDUM OPINION


A jury convicted Billy John Roberson of aggravated assault with a deadly weapon and assessed punishment at six years' imprisonment and a $5000 fine. See Tex. Pen. Code Ann. § 22.02 (Vernon Supp. 2005). We have adopted the trial court's findings that appellant is not indigent and that he no longer desires to prosecute the appeal. We submitted the appeal without the reporter's record and without briefs. See Tex.R.App.P. 37.3(c), 38.8(b)(4). Absent briefs, no points of error are before us. Finding no fundamental error, we affirm the trial court's judgment.
