OPINION AND ORDER


Petitioner Ralph Rivera moves to amend a previous Rule 60 (b) motion, pursuant to Rule 15 (a) of the Federal Rules of Civil Procedure. However, no Rule 60(b) motions remain pending before the Court. On September 8, 2004, the Court denied Rivera's Rule 60(b) motion for reconsideration, stating that Petitioner "presents no grounds upon which to question the soundness of this Court's earlier decision." Rivera cannot amend a petition that has already been dismissed. Therefore, Petitioner's Rule 15(a) motion is hereby denied.

SO ORDERED.
