Opinion

No. 05-06-00435-CV.

Opinion Issued January 2, 2007.

On Appeal from County Court at Law No. 5 Collin County, Texas Trial Court Cause No. 005-1707-05.

Before Justices WHITTINGTON, MOSELEY, and O'NEILL.

MEMORANDUM OPINION

On March 31, 2006, appellant filed a notice of appeal in this case. Appellant's brief was due on May 24, 2006. On June 12, 2006, appellant filed a motion to extend time to file his brief, but his motion was not considered until October 23, 2006 because he did not pay the filing fee until then. We granted appellant an extension and ordered him to file his brief by November 20, 2006. We cautioned appellant that if his brief was not filed by November 20, 2006 we would dismiss the appeal. Nevertheless, to date, appellant has not filed his brief or otherwise communicated with this Court regarding this appeal.

Accordingly, we DISMISS the appeal. See Tex. R. App. P. 42.3(c).
