Pursuant to appellants' agreed motion, we abated this appeal and remanded to the trial court for rendition of final judgment because appellants advised that a counterclaim for attorney's fees remained outstanding. We directed the filing of a supplemental clerk's record with the final judgment within 30 days of the date of our order. Appellants filed an update on May 11, 2017 to advise us that the supplemental clerk's record containing the final judgment would not be filed by the deadline in our order. A supplemental clerk's record was filed on May 17, 2017 certifying that no final judgment had been rendered. Months have passed and no supplemental clerk's record containing a final judgment has been filed.
Accordingly, we direct the parties to file a response to this order by October 11, 2017, explaining how this Court has jurisdiction or the appeal will be dismissed.
