Supreme Court of Florida.

115 So. 3d 1001 (Fla. 2013)

Opinion

No. SC12–1183.

2013-03-26

Annamarie RIETHMILLER, Petitioner(s) v. William RIETHMILLER, Respondent(s).

Because petitioner has failed to show a clear legal right to the relief requested, she is not entitled to mandamus relief. Accordingly, the petition for writ of mandamus is hereby denied. See Huffman v. State, 813 So.2d 10, 11 (Fla.2000). The Court retains jurisdiction to pursue possible sanctions against petitioner. SeeFla. R.App. P. 9.140(a).

Since 2010, Petitioner Riethmiller has initiated numerous proceedings in this Court pertaining to her divorce proceedings in the Circuit Court of the Twelfth Judicial Circuit, in and for Manatee County, Florida. See Riethmiller v. Riethmiller, 2012 WL 1859725 (Fla. May 15, 2012) (table) (mandamus petition dismissed); Riethmiller v. Riethmiller, 77 So.3d 1255 (Fla.2011) (table) (notice for review dismissed); Riethmiller v. Riethmiler, 67 So.3d 200 (Fla.2011) (table) (notice for review dismissed); Riethmiller v. Riethmiller, 67 So.3d 200 (Fla.2011) (table) (notice for review dismissed); Riethmiller v. Fabisiak, 64 So.3d 118 (Fla.2011) (table) (notice for review dismissed); Riethmiller v. Riethmiller, 67 So.3d 200 (Fla.2011) (table) (notice for review dismissed); Riethmiller v. Riethmiller, 67 So.3d 200 (Fla.2011) (table) (notice for review dismissed); Riethmiller v. Riethmiller, 60 So.3d 388 (Fla.2011) (table) (notice for review dismissed); Riethmiller v. Riethmiller, 60 So.3d 388 (Fla.2011) (table) (notice for review dismissed); Riethmiller v. Riethmiller, 69 So.3d 278 (Fla.2011) (table) (prohibition petition denied); Riethmiller v. Riethmiller, 57 So.3d 847 (Fla.2011) (table) (notice for review dismissed); Riethmiller v. Riethmiller, 67 So.3d 200 (Fla.2011) (table) (mandamus petition denied); Riethmiller v. Riethmiller, 67 So.3d 200 (Fla.2011) (table) (mandamus petition denied); Riethmiller v. Riethmiller, 48 So.3d 837 (Fla.2010) (table) (notice for review dismissed).

It appearing that the petitioner has abused the judicial process by initiating numerous proceedings in this Court that are either meritless or inappropriate for this Court's review, the Court now takes action. Annamarie Riethmiller is hereby directed to show cause on or before April 15, 2013 why she should not be barred from filing in this Court any future pleadings, motions, or other requests for relief pertaining to her divorce proceedings in the Circuit Court of the Twelfth Judicial Circuit, in and for Manatee County, Florida, unless such filings are signed by a member of The Florida Bar in good standing. See, e.g., James v. Tucker, 75 So.3d 231 (Fla.2011); Johnson v. Rundle, 59 So.3d 1080 (Fla.2011); Steele v. State, 14 So.3d 221 (Fla.2009); Pettway v. McNeil, 987 So.2d 20 (Fla.2008).

PARIENTE, LEWIS, QUINCE, CANADY, and PERRY, JJ., concur.
