Richland Grove Cattle v. Easterling

District Court of Appeal of Florida, Second District
Dec 21, 1984
460 So. 2d 591 (Fla. Dist. Ct. App. 1984)

Opinion

No. 84-1144.

December 21, 1984.

Appeal from Circuit Court, Pasco County; Ray E. Ulmer, Jr., Judge.

A.P. Gibbs of Gibbs, McAlvanah Hanson, P.A., Dade City, for appellant.

Donna Sumner Cox of Dayton, Sumner, Luckie McKnight, P.A., Dade City, for appellee.

Appellant challenges the trial court's adverse summary judgment. Our review of the record leads us to conclude that there has not been negated the existence of genuine issues of material fact. We therefore reverse the final summary judgment and remand this cause for further proceedings. St. Clair v. Smith, 445 So.2d 1113 (Fla. 2d DCA 1984).

GRIMES, A.C.J., and SCHEB and CAMPBELL, JJ., concur.
