ORDER


In its Order dated December 6, 2010, this Court remanded the case to Prudential's plan administrator to make a new benefits determination (Doc. 27). On December 6, 2010, Plaintiff Rhodes made an oral request to have this Court set a deadline for Prudential's new benefits determination. Upon consultation with both of the parties, this Court hereby sets a deadline of December 31, 2010 for the parties to agree to a settlement of Rhodes's benefits claim. If the parties do not reach a settlement by this date, Prudential will have until February 15, 2011 without the possibility for extension to make a new benefits decision.

IT IS SO ORDERED.
