ORDER

On September 1, 2006, plaintiffs filed a motion to consolidate these three cases. The motion was filed only in Case No. 2:05-cv-1113. The correct procedure would have been to file the motion in all three cases, because the parties in the latter two cases are different from the parties in the first-filed case. Nonetheless, the parties in those cases were aware of the filing of the motion, as reflected in Judge Abel's order filed on September 26, 2006, and they stated to Judge Abel that they would brief the motion. They have not. The Court therefore concludes that the motion is unopposed and that the statements made by plaintiffs concerning the existence of common issues, and the efficiencies to be served by consolidation, are accurate. The motion (#17) is therefore granted. All three cases (the latter two of which were previously consolidated with each other) are now consolidated. The pretrial order issued in Case No. 2:05-cv-1113 shall control future proceedings in all three cases.
