DECISION & ORDER ON MOTION
Motion by the appellant on an appeal from an order of the Supreme Court, Queens County, dated January 20, 2012, to extend his time to comply with a decision and order on motion of this Court dated December 4, 2012, to accept a certain "supplemental reproduced full record on appeal" filed with the motion as satisfaction of the provision in the decision and order on motion of this Court dated December 4, 2012, which directed him to file a supplemental record, and to waive the requirement that he file nine copies of the "supplemental reproduced full record on appeal."
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is granted to the extent that the decision and order on motion of this Court dated December 4, 2012, is amended by deleting the last decretal paragraph thereof and substituting therefor the following paragraph, and the motion is otherwise denied:
"ORDERED that on the Court's own motion, on or before March 15, 2013, the appellant shall either (1) serve two copies and file nine copies of a supplemental record containing the material attached to the appellant's motion papers and identified as R801 through R849, or (2) serve two copies and file nine copies of a replacement record, which contains, inter alia, the material attached to the appellant's motion papers and identified as R801 through R849."
