PRESENT:

Respondents having moved for an extension of time to file and serve a brief on the appeal taken herein from and order and judgment of the Supreme Court entered in the Office of the Clerk of the County of Niagara on January 12, 2016, and February 17, 2016,

Now, upon reading and filing the affidavit and affirmation of Michael J. Willett, Esq., sworn to February 3, 2017, and dated February 23, 2017, the notice of motion with proof of service thereof, and the affidavit of Jon F. Minear, Esq., sworn to February 20, 2017, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted to the extent that the first ordering paragraph of the order of this Court entered December 27, 2016, is hereby amended by deleting the date February 6, 2017, and inserting in its place the date March 8, 2017, and

It is further ORDERED that reply briefs, if any, shall be filed and served on or before March 23, 2017.
