Linda S. Restrepo and Carlos E. Restrepo d/b/a Collectively RDI Global Services and R&D International, Appellants, v. Alliance Riggers & Constructors, LTD, Appellee.

Appeal from the County Court at Law No. 5 of El Paso County, Texas (TC# 2012-DCV04523) ORDER

Pending before the Court are Appellants' motion and supplemental motion to stay the final judgment and a turnover order as well as Appellants' motion to strike Appellee's response. Appellants have established no basis for striking Appellee's response. Consequently, the motion to strike is DENIED.

Appellants' motion to stay includes a request that we stay the turnover order entered by the trial court on February 8, 2016. The turnover order is the subject of a separate appeal 08-16-00032-CV. Appellants have been declared indigent for purposes of appeal, but they have not superseded the final judgment as required by Rule 24 of the Texas Rules of Appellate Procedure. Appellants have not shown they are entitled to appeal without superseding the judgment. Accordingly, Appellants' motion and supplemental motion to stay the final judgment are DENIED.

IT IS SO ORDERED this 24th day of February, 2016.

PER CURIAM Before McClure, C.J., Rodriguez and Hughes, JJ.
(Hughes, J., not participating)
