Opinion

         Editorial Note:

This case has been marked 'not for publication' by the court.

Error to District Court, City and County of Denver, Hilbert Schauer, Acting Judge.

Sobol & Sobol, Harry Sobol, Denver, for plaintiff in error.

Berger, Rothstein & Gehler, S. Morris Lubow, Commerce City, for defendants in error.

Before SILVERSTEIN, C.J., and DWYER and DUFFORD, JJ.

         PER CURIAM.

This case was originally filed in the Supreme Court of the State of Colorado, and was subsequently transferred to the Court of Appeals under authority vested in the Supreme Court.

Plaintiff in error, a licensed money lender, made a series of loans to defendants in error. The lender brought suit to recover the amount allegedly due and unpaid on these loans, and the borrowers counterclaimed, alleging that the lender was indebted to them.

After a trial to the court, judgment was entered in favor of the borrowers in the amount of $447.

The claims of error set forth in the motion for new trial and argued in the briefs present no appellate question. The issues in the case were factual and the court resolved these issues on the basis of the conflicting evidence presented. The record supports the judgment of the court.

         The judgment is affirmed.
