This case is currently calendared for hearing on nonparties Gerald Richard Newbury and four of his wholly owned companies' Motion to Quash or Modify Subpoena, For a Protective Order, and Award Attorney's Fees filed December 14, 2023. On May 17, 2024, the parties filed a Joint Status Report (Doc. 63) informing the Court that the "parties and the nonparties, a hearing on the nonparties' motion is no longer necessary." Upon due consideration, it is hereby

ORDERED that this case is stricken for hearing from the calendar of the Court's May 20, 2024, Helena, Montana, trial session, and the parties are excused from appearing at the hearing on May 20, 2024. It is further

ORDERED that, on or before August 19, 2024, the parties shall file with the Court either a joint report (or, if that is not expedient, then separate reports) describing the status of the case or a stipulated decision document. It is further

ORDERED that jurisdiction of this case is retained by the undersigned judge. It is further

ORDERED that the Clerk of the Court shall serve a copy of this Order on counsel for Gerald Richard Newbury, Complete Restoration, LLC, Trigger, LLC, B&R Land Company, LLC, and Stag Properties, LLC at the address set forth in the signature block of the Motion to Quash or Modify Subpoena For A Protective Order, and Award Attorney's Fees (Doc. 38).
