Kristen R Rene-Pollard v. Timothy W Pollard

LC No. 16-002646-DM

Noah P. Hood Presiding Judge, Kathleen Jansen Kirsten, Frank Kelly Judges

ORDER

Noah P. Hood, Presiding Judge.

This Court's opinion and order entered on November 22, 2022, vacated the trial court's order adopting the recommendation from the Friend of the Court (FOC), and remanded, while retaining jurisdiction, for further proceedings. Specifically, the trial court was ordered to conduct a de novo hearing to state the reason for not allowing plaintiff's expert testimony, without a hearing, after plaintiff's objection to the FOC recommendation. On remand, the trial court conducted a hearing and adopted its previous order adopting the FOC recommendation. Because the remand proceedings have rendered moot any remaining appellate issues, this appeal is DISMISSED. MCR 7.211(C)(2); MCR 7.216(A)(7). We do not retain jurisdiction.
