Case No. 3:10-cv-145
12-02-2013
District Judge Walter Herbert Rice
Magistrate Judge Michael R. Merz
ENTRY
This case was originally referred to the undersigned October 29, 2010, as part of the original Pretrial Order in this case (Doc. No. 15). That reference, however, expired by its own terms on October 15, 2010, the discovery cut-off date set in the Order. On December 30, 2011, the dates were extended and on January 3, 2011, the case was again referred (Doc. Nos. 19, 22). Judge Rice thereafter set an in-person settlement conference and referred the case specially to the undersigned to act as mediator (Doc. Nos 56, 58). The mediation was unsuccessful (Doc. No. 59). On December 19, 2011, the undersigned entered a new Scheduling Order (Doc. No. 65).
On August 2, 2012, the reference to the undersigned again expired by its own terms because the discovery deadline had passed; Judge Rice resumed management of the case. On notice of settlement, Judge Rice dismissed the case August 21, 2012 (Doc. No. 113). However, a motion to reopen was filed October 15, 2012, and sustained by Judge Rice on October 30, 2012 (Doc. No. 115). Eventually a new Scheduling Order was entered by Judge Rice on August 2, 2013 (Doc. No. 139) which set a deadline for discovery of November 8, 2013. The case was again referred to the undersigned for pre-trial management until the discovery cut-off. Id. PageID 1510-11.
The discovery deadline having passed, the reference to the undersigned is again TERMINATED by virtue of the Scheduling Order.
Michael R. Merz
