MEMORANDUM OPINION


On March 16, 2009, this Court received a "notice" from appellee's counsel stating the parties have settled and that a motion to dismiss would be forthcoming. When we did not receive a motion to dismiss by April 6, 2009, we sent the parties a letter directing them to file a motion to dismiss the appeal within ten days. We further advised the parties that if we did not receive a motion to dismiss within that time, we would, without further notice, dismiss the appeal. To date, we have not received a motion to dismiss, nor have the parties otherwise communicated with the Court regarding the appeal. Accordingly, we dismiss the appeal. See Tex. R. App. P. 42.3(c).
