On order of the Court, the application for leave to appeal from the January 11, 2002, decision of the Court of Appeals is considered, and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we REMAND this case to the Court of Appeals for reconsideration in light of Stanton v City of Battle Creek, 466 Mich. 611 (2002), and Chandler v Muskegon County, 467 Mich. 315 (2002).

We do not retain jurisdiction.

Kelly, J., would deny leave to appeal.
