Respondent Lawrence Champoux having moved to dismiss the appeal taken herein from an order of the Monroe County Court entered in the Office of the Clerk of the County of Monroe on March 28, 2018, on the ground that appellant failed to perfect timely the appeal,

Now, upon reading and filing the affidavit of Leo G. Finucane, Esq., sworn to June 22, 2018, and the notice of motion with proof of service thereof,

It is hereby ORDERED that the motion is granted, and the appeal as it relates to respondent Lawrence Champoux is dismissed without costs.
