JAMES MARVIN REED, JR., Petitioner v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Mark V. Holmes Judge

This case was on the March 15, 2021 St. Paul, Minnesota trial calendar, but we continued it because Mr. Reed still had some time to serve in prison. He was released earlier this year, and we spoke with the parties on June 21. A couple major issues raised in the notice of deficiency seemed to have been settled by concession on both sides, and the parties had agreed to talk and try to settle the rest. But then Mr. Reed stopped communicating with the IRS's lawyer and did not return the Court's calls to try to set up another conference to discuss progress. The IRS reported that he has now resumed communication and again promised to supply the IRS some supporting documentation. It is

ORDERED that on or before February 22, 2023 respondent shall file a status report describing any progress in contacting Mr. Reed or file a motion to dismiss this case for failure to prosecute.
