ORDER


This 11th day of July 2011, after careful consideration of the parties' briefs and the record, we find it manifest that the judgment below should be affirmed on the basis of the Superior Court's October 26, 2010 decision, which adopted the Commissioner's well-reasoned recommendations and denied appellant's third motion for postconviction relief. The trial court did not err in finding that appellant's motion was untimely and that appellant had failed to overcome this procedural hurdle.

NOW, THEREFORE, IT IS ORDERED that the judgment of the Superior Court is AFFIRMED.
