ORDER OF DISMISSAL WITH PREJUDICE


On this the 9th day of February, 2004, came on to be heard the Agreed Motion to Dismiss filed herein by Plaintiff RAYTHEON COMPANY, and Defendant, MCDATA CORPORATION. The Court, having considered said Motion, and being advised of the agreement between Plaintiff and Defendant, MCDATA CORPORATION, to settle all claims in controversy between them, is of the opinion that the Motion should be granted.

IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED that all claims asserted by Plaintiff against Defendant, MCDATA CORPORATION, and all claims made by Defendant, MCDATA CORPORATION, against Plaintiff in the above numbered and styled cause be, and the same are, hereby dismissed with prejudice to the rights of either party to refile same or any part thereof. mo.dismiss.mcdata.DOC

IT IS FURTHER ORDERED that taxable costs of court incurred are to be borne by the party incurring the same.
