JEYAKUMAR RATHINAM, et al., Plaintiffs, v. ASHOK SPIRITUAL HEALING CENTER, Defendant.

Judge Thomas M. Rose

ENTRY AND ORDER STRIKING ANNAMALAI'S AMENDED

COMPLAINT AND REQUEST FOR INJUNCTIVE RELIEF (Doc. #10)

On March 31, 2014, a Complaint was filed by a number of Plaintiffs against the Ashok Spiritual Healing Center. (Doc. #1) This Complaint was filed by an attorney. On May 27, 2014, Lloyd Whitaker in his capacity as Trustee of the Estate of Hindu Temple and Community Center of Georgia, Inc. (the"Trustee") was granted leave to intervene as a Defendant. (Doc. #6.) On June 3, 2014, Annamalai Annamalai ("Annamalai") was granted leave to intervene as a pro se Plaintiff. (Doc. #8.)

On June 11, 2014, Annamalai filed an Amended Complaint and Request for Injunctive Relief pro se. (doc. #10). This Amended Complaint and Request for Injunctive Relief appears to be only against the Trustee.

The Amended Complaint and Request for Injunctive Relief filed by Annamalai must be struck. The Amended Complaint and Request for Injunctive Relief is not filed in accordance with the Federal Rules of Civil Procedure. Annamalai cannot amend the Complaint filed in this matter without approval of the existing Plaintiffs nor can he amend a complaint pro se on behalf of others. If Annamalai has a complaint against the Trustee, he is free to file it in a separate action and the Court will consider whether the Court has jurisdiction over the Trustee, whether the Court has subject matter jurisdiction and whether or not it is a valid complaint, among other considerations.

DONE and ORDERED in Dayton, Ohio this Eleventh Day of June, 2014.
