ORDER
The United States Magistrate Judge has issued a report (Doc. 10) recommending that the Defendant's Motion to Dismiss (Doc. 8) be granted. The pro se Plaintiff has filed the following objections and motions in response: Notice of Non-Acceptance of Removal and Petition to Release Case Back to State Jurisdiction (Doc. 11), and Petitioner's Brief in Support of Petition (Doc. 12). The Magistrate Judge has also issued a second report (Doc. 15) recommending that the Plaintiff's Notice of Non-Acceptance of Removal and Petition to Release Case Back to State Jurisdiction (Doc. 11) be Denied. The Plaintiff has not filed any objections to the second report (Doc. 15) and recommendation of the Magistrate Judge and the time for objecting has expired.
Upon an independent examination of the file and upon due consideration, the reports and recommendations of the Magistrate Judge (Docs. 10 15) are adopted, confirmed and made a part hereof. The Plaintiffs objections (Docs. 11 12) are OVERRULED and the Plaintiffs Petition to Release Case Back to State Jurisdiction (Doc. 11) is DENIED. The Defendant's Motion to Dismiss (Doc. 8) is GRANTED, and this case is DISMISSED with prejudice. The Clerk is directed to enter judgment accordingly, terminate any pending motions, and close the file.
