ORDER

On appellee's motion, we dismissed this appeal December 8, 2015 for failure of appellant to file his brief. In our opinion dismissing the appeal, we observed the brief was first due July 16, 2015 and that appellant, a pro se inmate, had been given more than an additional 100 days to file his brief. We also observed he had failed to respond to appellee's motion, which was filed November 24, 2015.

Ten days after we dismissed, we received a letter from appellant informing us he did not receive appellee's motion until December 2, 2015, and he was preparing an objection to the motion and his brief. On December 28, 2015, appellant filed his objection to the motion to dismiss, and, although he did not file a brief, stated again he was preparing a brief. In neither the letter nor the motion did appellant challenge our opinion dismissing the appeal.

We OVERRULE appellant's objection.
