The judgment is to be modified so as to include a declaration, in accordance with the endorsement on the defendant's motion to dismiss, that the exclusionary proviso of G.L.c. 127, § 129, does not violate the rights of the plaintiffs under the United States Constitution or the Massachusetts Declaration of Rights; the judgment, as so modified, is affirmed.
