Present — Taylor, P.J., McCurn, Love, Kimball and Piper, JJ.


Judgment affirmed, without costs of this appeal to either party. All concur, except Taylor, P.J., who dissents and votes for reversal and for dismissal of the claim on the ground that the proofs fail to establish that the State was negligent. (The judgment is for claimant on a claim against the State for personal injuries sustained by reason of negligent condition of State highway.)
