MEMORANDUM OPINION


On August 15, 2005, we suspended the appellate deadlines in this case pending preparation of settlement documents. See 4th Tex. App. (San Antonio) Loc. R. 2. On September 14, 2005, Appellant filed an agreed motion to dismiss this appeal with prejudice representing that all matters in controversy were fully and finally settled. The motion contains a certificate of service to appellee, who has not opposed the motion. Therefore, we reinstate this cause and grant the motion and dismiss the appeal. See Tex.R.App.P. 42.1(a)(2). Costs of the appeal are taxed against the parties incurring the same.
