Order affirmed, with $20 costs and disbursements. The date for the examination to proceed shall be fixed in the order. No opinion.


Van Voorhis, J., concurs in the result on the ground that the action is, in truth, for equitable relief, and that if plaintiff is successful it will result in an interlocutory judgment for an accounting. On the accounting the referee can take the necessary testimony without the aid of a previous examination before trial. Settle order on notice.
