ORDER


On September 1, 2006, after plaintiff in Case No. 2:06-cv-351 consented to this procedure, that case was transferred to the undersigned's docket for purposes of both pretrial management and trial. The parties to Case No. 2:05-cv-859 had previously consented to trial before the Magistrate Judge, and the defendants in that case, who are also the defendants in Case No. 2:06-cv-351, did not object to the transfer, so the Court concludes that all parties consent to the Magistrate Judge's plenary disposition of both cases pursuant to 28 U.S.C. § 636(c). The Court also construes the parties' filings to be an agreement that the two cases be consolidated.

Therefore, these cases are consolidated for all further proceedings pursuant to Fed.R.Civ.P. 42(a).
