RANDI QUINTELL, Plaintiff, v. DANIEL TOMKO, Defendant.

REPORT AND RECOMMENDATION

Joseph C. Spero Chief Magistrate Judge

On January 3, 2023, the undersigned magistrate judge granted Plaintiff Randi Quintell's application to proceed in forma pauperis and ordered her to show cause why her complaint should not be dismissed with prejudice under 28 U.S.C. § 1915(e)(2)(B) because she has failed to allege any basis for federal jurisdiction. See generally Order to Show Cause (dkt. no. 6). The deadline for Quintell's response was February 8, 2023. That date has passed and Quintell has not filed a response. Accordingly, for the reasons stated in the order to show cause, the undersigned recommends that this case be DISMISSED WITH PREJUDICE.

Because not all parties have appeared and consented to the jurisdiction of a magistrate judge under 28 U.S.C. § 636(c), this case will be reassigned to a United States district judge for all further proceedings, including action on the recommendation of this report. Randi Quintell may file an objection to this recommendation no later than fourteen (14) days from the date on which she is served a copy of this Report and Recommendation.

IT IS SO ORDERED.
