Jennifer M. Pugh, Petitioner-Appellant, For a Judgment Pursuant to Article 78of the Civil Practice Law and Rules, v. Raymond Kelly, as Police Commissioner of the City of New York, et al., Respondents-Respondents.


An appeal having been taken from an order of the Supreme Court, New York County, entered on or about April 26, 2013, and said appeal having been perfected, And, respondents-respondents having moved to dismiss the aforesaid appeal or, in the alternative, to adjourn the appeal (M-6591), And, petitioner-appellant having cross-moved to have the appeal heard (M-1002), Now, upon reading and filing the papers with respect to the motion and cross motion, and due deliberation having been had thereon, it is Ordered that respondents' motion is granted and the appeal is dismissed (M-6591). Petitioner's cross motion is denied (M-1002).
