ORDER ADOPTING REPORT AND RECOMMENDATION AND DENYING PETITION FOR A WRIT OF HABEAS CORPUS


Came this day for consideration the federal habeas corpus application filed by petitioner MARVIN PRUETT. On July 2, 2004, the United States Magistrate Judge issued a Report and Recommendation in this cause, recommending therein that the instant habeas application be denied. Petitioner has not filed objections to the Magistrate Judge's Report and Recommendation although he was granted an extension until August 3, 2004 to do so.

The undersigned United States District Judge has made an independent examination of the record in this case including the Report and Recommendation of the Magistrate Judge. The District Judge is of the opinion the Magistrate Judge's Report and Recommendation should be, and hereby is, ADOPTED.

Accordingly, the petition for a writ of habeas corpus is hereby DENIED.

LET JUDGMENT BE ENTERED ACCORDINGLY.

IT IS SO ORDERED.
