Adrian Prouty, Appellant v. The State of Texas, Appellee

FROM THE 22ND DISTRICT COURT OF HAYS COUNTY
NO. CR-18-0636 , THE HONORABLE R. BRUCE BOYER, JUDGE PRESIDING ORDER

PER CURIAM

Appellant's brief on appeal was originally due on May 9, 2019. On counsel's motion, which was filed on April 26, 2019, along with counsel's motion to withdraw, the time for filing was extended to July 9, 2019. The Court subsequently granted in part appellant's second motion for extension of time, which he filed pro se, and extended the time for filing to August 8, 2019. Appellant's newly retained counsel has now filed a third motion, requesting that the Court extend the time for filing appellant's brief. We grant the motion for extension of time and order appellant to file a brief no later than September 9, 2019. No further extension of time will be granted and failure to comply with this order will result in the referral of this case to the trial court for a hearing under Rule 38.8(b) of the Texas Rules of Appellate Procedure.

It is ordered on August 23, 2019. Before Justices Goodwin, Baker, and Kelly Do Not Publish
