Opinion

Opinion filed December 12, 2005.

An appeal from the Circuit Court for Escambia County, Nickolas P. Geeker, Judge.

Mark J. Upton, Daphne, Alabama, for Appellant.

Joseph L. Hammons, Pensacola, for Appellee.

Upon consideration of the appellant's response to the Court's order of October 27, 2005, the Court has determined that the order denying the appellant's "Renewed Motion for Directed Verdict, Motion for Judgment Notwithstanding the Verdict, or in the Alternative, for a New Trial," is not an appealable order.
