AGOSTINI, III, DEFENDANT, MICHAEL COLLINS, INDIVIDUALLY AND DOING BUSINESS AS PFOHL'S TAVERN, RANDY COLLINS, INDIVIDUALLY AND DOING BUSINESS AS PFOHL'S TAVERN, AND PFOHL'S TAVERN, INC., DEFENDANTS-RESPONDENTS.


Respondent Randy Collins, individually and doing business as Pfohl's Tavern, having moved to dismiss the appeal taken herein from an order of the Supreme Court entered in the Office of the Clerk of the County of Onondaga on November 30, 2011, on the ground that appellant has failed to perfect timely the appeal,

Now, upon reading and filing the affidavit of Edward J. Smith, III, Esq., sworn to April 10, 2012, and the notice of motion with proof of service thereof,

It is hereby ORDERED that the motion is granted, and the appeal is dismissed without costs.
